These Terms & Conditions ("Terms") govern your access to and use of the websites, applications, monitoring devices, and services (collectively, the "Services") provided by American Tracking Services ("ATS," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be authorized and of legal age to use the Services. You are responsible for keeping your login credentials confidential and for all activity under your account. Agencies and courts are responsible for ensuring they have lawful authority and any required consent or court order to enroll and monitor individuals.

2. Use of the Services

ATS provides electronic monitoring and supervision technology, including GPS and location tracking, geofencing, alerts, reporting, communications, and related tools. The defendant/participant applications are intended exclusively for authorized individuals enrolled in a monitoring program. You agree not to misuse the Services, attempt to access data you are not authorized to access, interfere with or disrupt the Services, reverse engineer them, or use them for any unlawful purpose.

3. Monitoring Data — Accuracy and Operational Notice

Location and device data may be delayed, interrupted, or inaccurate due to GPS signal conditions, cellular coverage, device battery or charging status, tampering, or third-party network outages. The Services are decision-support tools and are not a substitute for law enforcement, emergency services, or independent professional judgment. In an emergency, contact 911 or your local authorities. ATS does not guarantee the detection or prevention of any violation, flight, or harm.

4. Fees and Payment

Fees, rates, and billing cycles are as described in your order, subscription, or agreement with ATS. Payments are processed by our third-party payment provider. Late or failed payments may result in suspension of the Services.

5. Intellectual Property

All content and materials in the Services — including text, graphics, logos, and software — are the property of American Tracking Services or its licensors and are protected by intellectual-property laws. You receive a limited, revocable, non-transferable license to use the Services in accordance with these Terms.

6. Third-Party Services

The Services rely on third-party providers for functions such as communications, payments, mapping, and scheduling. Their availability and terms are outside our control, and ATS is not responsible for third-party services or outages.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, American Tracking Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on monitoring data, arising out of or related to your use of the Services.

10. Indemnification

You agree to indemnify and hold harmless American Tracking Services from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate access to the Services for violation of these Terms, non-payment, or as required by law. Obligations relating to ongoing court-ordered or agency supervision continue as required by the responsible agency or court.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict-of-law principles.

13. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last Updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
